CHAPTER-1 INTRODUCTION

1.1. The Right to Information Bill, 2005 as passed by the Houses of Parliament received the assent of the President of India on 15th June 2005 and thus the Right to Information Act, 2005 (Central Act 22 of 2005) has come into force.
The provisions of sub-section (1) of Section 4, sub section (1) and (2) of Section 5, Sections 2, 12, 13, 15, 16, 24, 27 and 28 of the Act came into force at once and the remaining provisions of the Act came into force on the 12th October 2005.
The Right to Information Act, 2005 (Central Act 22 of 2005) has been enacted to provide for setting out a practical regime of the right to information for citizens to secure access to information under the control of Public Authorities, in order to promote transparency and accountability in the working of every public authority to provide information to citizens who desire to have it and contain corruption and to hold Government and their instrumentalities accountable to the governed keeping in mind the preservation of confidentiality of sensitive information.
In exercise of the powers conferred by Section 27 of the Right to Information Act, 2005, the state government made the “ Tripura Right to Information Rules, 2008” and published vide Notification No. F. 3(5)-GA(AR)/2005 (L) Dt. 20.06.2008 of GA (AR) Department published in Tripura Gazette on February 04,2008 against Extraordinary Issue.
1.2. Organisation of the Information.
The organization of the information is given chapter-wise in the index.
1.3. Contact Persons :-
The Public Information Officers, Asst. Public Information Officers i.e. under Appellate Authorities of Public Works Department, Tripura shall be the contact persons in the Department.
1.4. Procedure and Fee Structure for getting Information.
(a) Every application for obtaining information under sub-section (1) of the section
6 of the Act shall be accompanied by an application fee of Rs.10/-(Rupees Ten only) by way of cash or Demand Draft or Bankers Cheque or Indian Postal Order or any other mode of remittance prescribed by the Government from time to time payable under the head of account “0059 Major Head, 80 Sub major Head, 800 Minor Head, 00 Sub Minor Head
The applicant may also remit the fee under the above head of account in the Treasury / Pay and Accounts Office / State Bank of India / Reserve Bank of India and produce the chalan to the Public Information Officer as an evidence for having remitted the fee.
(b) For providing the information under sub-section (1) of section 7 of the Act, a fee shall be charged by way of cash against proper receipt or by Demand Draft or
Bankers Cheque payable in the above head of account, at the following rates:-
(i) Rupees two each page in A-4 or A-3 size paper created or copies.
(ii) Actual charge or cost price of a copy in larger size paper;
(iii) Actual cost of price for samples or models; and
(iv) For inspection of records, no fee for the first hour, and a fee of rupees five
for each subsequent hour or fraction thereof.
(c) For providing the information under sub-section (5) of section 7, the fee shall be charged by way against proper receipt or by Demand Draft or Bankers Cheque in the above head of account following rates-
(i) for information to provide in diskette or floppy rupees fifty per diskette of floppy; and
(ii) for information to provide in printed form, at the price fixed for publication.
Persons below the poverty line are exempted from the payment of fee mentioned in the above seeking information under the Right to Information Act, 2005. The list of persons below the poverty line approved by the Gram Panchayat and Local Bodies will be the basis for claiming the concessions.
CHAPTER II
Particulars of organisations, functions and Duties.
2.1. Objects / purpose of the Public Authority.
The Public Works Department (R&B) functions under the control of Secretary to Government and deals with policy making and implementation on all matters concerning the Roads, Bridges, Building constructions under jurisdiction of the Department
2.2. Brief History.
This Department is one of the largest Department in the state. It has three wings, Roads & Bridges, Water Resources(WR) and Drinking Watersupply and Sanitation(DWS). Public Works Department(R&B) is in-charge of implementing schemes related to roads, bridges and constructing buildings for State Government Departments and Government agencies including maintenance of roads, bridges, and public buildings.
2.3. Duties / Main activities and list of services provided by the Public Authority.
Policy Making
All matters relating to sanction and implementation of schemes for Roads, Bridges and Buildings as and when entrusted to the department.
Public Works Department of Govt. of Tripura primarily executes the following different vivid development works.
· Construction of New Roads & Bridges. · Maintenance and repairs of existing Roads and Bridges. · Construction of Govt. buildings. PWD is the major deptt for providing residential and office accommodation including Health and Educational
Institutions as well as accommodation for the security forces.
· Maintenance and Repairs of existing Govt. buildings for the identified departments and buildings. · Undertaking Deposit Contribution works relating to different Departments of Govt. of Tripura as well as of other Local Bodies · Fixation of rent of Private premises requisitioned for housing Govt. offices. · Allotment of government accommodation as per Rules of the Government. · Maintaining reservation of accommodation in Inspection Bunglows of the department. · To permit construction of approaches on both sides of roads to private individual, other institutions, factories, Petrol Pumps etc. · To allow irrigation drains, electricity lines, telephone duct cables etc. along and across the roads. · To evacuate the encroachment coming along the road sides · Issue of certificates periodically to Cinema Houses about stability of structures / arrangement related to electrical fittings conforming to Cinema Regulation Act. · Advice to the Government for Hazard free constructions and for formulation and amendment of Building Bye-laws with reference to National Disaster Management Act. · Capacity building of the engineers, masons, helpers involved in engineering construction. · Formulation of Rules and guidelines for bidding process in the state · Enlistment rules of contractors including issuing license to the electrical contractors by Licensing Board
In addition, the department is also acting as a consultant to other government departments for preparation of DPRs, plan of building projects etc.
Establishment
All service matters of Engineers from the level of Junior Engineer to Chief Engineer. Ministerial staff of all wings of the Public Works Department, and also the controlling authority of all common category staffs including Power Department (Now TSECL).
2.4. Administrative Units
Chief Engineer, PWD (R&B) is the Head of the Department and he is supported by six Superintending Engineers of working circles, Viz. Circle-I, Kumarghat, Circle-II, Agartala, Circle-III, Udaipur, Circle-IV, Agartala, Circle-V, Ambassa and project Circle, Agartala located at Secretariat Complex. In addition there are Superintending Engineers in office of the Chief Engineer, PWD (R&B) to support him for the works. As a part of secretariat structure, three Deputy Secretaries are posted in the same office who also work as Engineering Officer to CE, PWD(R&B). To look after all financial matters, budget etc. of the department, one Finance Officer is also posted in the same office, who also functions as Under Secretary to the department.

CHAPTER III
3.1. Power and duties of Officers and Employees:
The duties and responsibilities of the officers and staff under the department are generally guided by the rules and procedures of the government. But the duties and responsibilities of the engineering officers are mainly guided by CPWD code and manuals. The duties and responsibilities of the engineering officers of the department as per CPWD code are given in brief:
3.1.1. Chief Engineer- Chief Engineer will exercise full powers for purposes of execution of works and is responsible to government for the efficient carrying out of all works in his administration and for accounts pertaining to all such works. Chief Engineer, PWD (R & B) is the appointing and controlling authority for all non-gazetted staff under common category including 3 wings of PWD and Power Department (now TSECL).
3.1.2. Superintending Engineer- The administrative unit of the department is the circle, where in-charge of this administrative unit is Superintending Engineer. The Superintending Engineers should examine the books of Divisional Officer of their subordinates and see that matters relating to the primary accounts are attended to personally by the Divisional and Sub-Divisional Officers and that the accounts fairly represent the progress of each work. It is also his duty to examine the registers of works and when he considers it necessary he may require a Divisional Officer to report to him monthly or at longer intervals on a work slip, the total expenditure to date under each sub-head of a work, in contrast with the sanctioned estimate. When a revised estimate is required it will also devolve on the Superintending Engineers to see that it is submitted in due time to the sanctioning authority.
It is the duty of Superintending Engineer to inspect the various works in progress within his circle and to satisfy himself that the system of management prevailing is efficiently and economical, that the different stores are duly verified according to the rules laid down, and that there is no accumulation of stock in any division beyond its requirements. He should record the results of his inspection of the works as frequently as considered necessary and ensure that the defects pointed out on each occasion are promptly rectified.
The Superintending Engineer is also responsible that no delay is allowed to occur in the submission of completion reports. He should further so far as may be possible. Inspect periodically all important public buildings and other works within his jurisdiction.
The Superintending Engineer will inspect the divisional offices at-least once a year and record the results of such inspection in the prescribed form. He is also required to satisfy himself, from time to time, that the staff employed in each division is actually necessary and adequate for its management.
The Superintending Engineer is required to make it his special duty during his tours to see that measurement books are carefully kept and measurements properly recorded, and that they are complete records of the actual measurements of each kind of work done for which certificates have been granted. He should also see that any orders of the Department regarding check measurement are duly observed.
The Superintending Engineer is authorized to correspond direct with any of the local authorities, civil or military within the area of his jurisdiction.
Functions of Superintending Engineer posted in office of the Chief Engineer is to provide support to Chief Engineer basically for planning, monitoring, quality control etc. and any other works assigned to SE by CE.
3.1.3. Divisional Officer (Executive Engineer)
The executive unit of the Department is the division in charge of a Divisional Officer, who is responsible to the Superintending Engineer for the efficient execution and management of all works within his division. It is therefore part of his duties to organize and supervise the execution of works and to see that they are suitably and economically carried out with materials of good quality.
The Divisional Officer, as the primary disbursing officer of the division, is responsible not only for the financial regularly of the transactions of the whole division but also for the maintenance of the accounts of the transactions correctly. He is, therefore, required to take the necessary steps for obtaining case for the works under his control to keep accounts and to submit them punctually to the Audit Officer under the rules for the time being in force. He is responsible for the arrangements for account keeping, in which matter he will be assisted by his Divisional Accountant, and he must see that his accounts are posted from day to day and that the Accountant carries out his duties regularly and punctually.
The Divisional Officer is required to inspect at-least once a year, the more important buildings and works in his division and is responsible that proper measures are taken to preserve them and to prevent encroachment on Government lands in his charge. He should keep accurate plans of all such lands and take care that his subordinates make themselves acquainted with the boundaries and see that they are respected.
A Divisional Officer must keep on record in his office the following plans, or such of them as are required in his division:
(i) Complete plans sections and elevations of every building or other work under his charge as actually constructed, any subsequent alteration being carefully noted. The boundaries of the ground attached to any buildings should be distinctly shown.
(ii) Plans of roads under his charge, showing the quarries when metal is obtained.
Immediately a work is finished, it is the duty of the Divisional Officer to close the accounts of it in the manner indicated in paras. 10.6.5 to 10.6.10 of C.P.W.A. Code and to prepare the completion report if required by rules.
A Divisional Officer is required to report immediately to the Superintending Engineer any important accident or unusual occurrence connected with his division and to state how he has acted in consequence.
It is the duty of the Divisional Officer to administer the grant made for public works in his division and with this object, to keep a close watch over the progress of expenditure against it with a view to seeing that no excess is permitted to occur. He should accordingly keep himself informed of such circumstances as may affect the progress of expenditure in order to take timely steps for obtaining extra funds or surrendering probable savings, as may be necessary. The Divisional Officer should also take necessary to reconcile the expenditure recorded in his books with that in the books of the Audit Officer in the prescribed manner.
The Divisional Officer is responsible for the detailed assessment of the revenue to be obtained from works and other sources within his division, and will maintain such records and accounts for the purpose as may be prescribed.
3.1.4. Sub-Divisional Officer (Assistant Engineer)
The Division is divided in the sub-divisions in charge of Sub-Divisional Officers who is responsible to the Divisional Officer for the management and efficient execution of works within their sub-divisions.
The Sub-Divisional Officers is required to maintain the initial account records of cash and stores under his charge as well as Works Abstracts, with certain accompaniments, for each work, in progress in the sub-division under the rules for the time being in force. He should ensure that all accounts returns are submitted punctually to the Divisional Officer and are correct in all respects.
The Sub-Divisional Officer is responsible that the value of stores sold to municipalities, Local Funds and the Public, and issues made to contractors, under the orders of the competent authority is recovered in advance.
As the accounts of works are based on (a) The Muster Roll and (b) the Measurement Book, it is an important function of the Sub-Divisional Officer to see that these initial records are written up neatly in accordance with prescribed rules to avoid all doubts about their authenticity.

CHAPTER VI

6.2. At present there is no formal mechanism to seek consultation / participation of public in formulation of policies of this Department. The suggestions and views on policy matters and programmes received from the public are given due weightage by this department in formulating policies and programmes. The recommendations / observations made by the Public Accounts Committee/ Estimate Committee/ Petitions Committee, etc. of the Legislative Assembly are also acted upon by this Department.
6.3. In addition, Hon;ble Minister, PWD takes review of the departmental works almost in every year where public representatives of different panchayet levels are attended and their fruitful suggestions are duly recorded and where possible, these are incorporated into the policy and also in the work programme of the department.

The board is meant for functioning as per rules framed by the Board and basically involved with construction of buildings, roads and bridges in the state. The board also involved in implementing ownership housing.
7.1.3. Tripura Rural Roads Development Agency:
This is a society constituted for PMGSY/ Bharat Nirman programme in the state as per guidelines issued by Rural Development Department, Government of India.
Since PWD (R&B) is involved with important infrastructure projects in the state, Chief Engineer, Superintending Engineer, Executive Engineer are members of many committees constituted by the government and nominated bodies. Even at sub divisional level, Asst Engineers are also nominated as member of many committees and sub committees.

Execution of subsidy programme
The department as such has no scheme.
CHAPTER XIV
Particulars of Recipients of Concessions, permits or authorization granted.
No concession, permits and authorization are granted to the Public in this Department.
Allotment of government residences are done by the department where as per rule provision has been made for 25 % Quarters to ST category, Critical diseases etc. the license fee for Group-D staffs are exempted as per rules provided they occupy Type-I quarters in place of their posting.
The unemployed engineering diploma and degree holders are exempted from depositing earnest money for the works costing upto Rs. 5.0 lakhs. As a policy of the department, works are awarded to Deed Firms registered with the department for petty works in Divisions/ Sub divisions. For the remote areas, works are awarded to the tribal individuals subject to limitation of financial power of the concerned working division.
CHAPTER XV
Norms set by the Department for the discharge of its function. Chief Engineer, Public Works Department(R&B) is the official head of the Public Works Department (R&B) The duties and responsibilities of each office are guided by the general rules set by the government.
